Currently Enacted by the Ministry of Agriculture

The Biosecurity Act 2008 was enacted by Parliament in October 2008 and became effective as of 1 January 2009. This Act was developed to update previous acts relating to the Agriculture sector, especially in the areas of border control and quarantine procedures.

The Biosecurity Act 2008 may supercede previous acts, however these acts have not been repealed and the Biosecurity Services and the legal fraternity may refer to these acts in association with the 2008 Biosecurity Act for clarity and support in any litigation proceedings.

The Ministry is responsible for enacting the following legislation:

  • Plants Act 1973
  • Plant Quarantine Regulations 1993
  • Fruit and Vegetables Export Regulations 1993
  • Container Import Regulations 1993
  • Domestic Plant Quarantine Regulations 1993
  • Animals Act 1975
  • Animal Importation Regulations 1993
  • Animal Diseases Prevention Regulations 1982

In addition to the above, the Ministry complies with the PERCA, MFEM and PSC Acts.
